What Is an Emergency Protective Order (EPO)?

An Emergency Protective Order (EPO) is a powerful, short-term court order designed to protect you when there’s an immediate risk of harm. In California, law enforcement can request an EPO on your behalf — often right after you call 911.

Because of its urgency, an EPO goes into effect immediately once granted.

When and How an EPO Is Issued

  • An EPO can be requested 24/7 by a responding police officer who believes there is “immediate and present danger” of domestic violence, child abuse, or elder abuse.
  • A judge reviews the request (sometimes via phone), and if granted, the EPO becomes active immediately.
  • The duration of the EPO is limited: typically 5 business days or 7 calendar days, whichever is shorter.
  • The short-term EPO gives you critical breathing room: during that time, you can apply for a more permanent restraining order (e.g., a Temporary or Domestic Violence Restraining Order).

Who Qualifies for an EPO

You may be eligible for an EPO if:
  • You are experiencing a pending threat of domestic violence, abuse, or stalking.
  • You are a dependent adult or senior and at risk of abuse.
  • You are a minor threatened with abuse or abduction by a relative or household member.
  • You are related to the restrained person through a close relationship: spouse, dating partner, domestic partner, or co-parent.

What an EPO Can Do to Protect You

An EPO may include a variety of protections tailored to your situation, such as:
  • No contact or communication (via phone, text, email, social media) with the restrained person.
  • Stay-away orders: the restrained person may be ordered to stay a certain distance from you, your home, or other places you frequent.
  • Exclusion from shared residence: they may be required to leave a home you share.
  • Firearm restrictions: they might be ordered not to possess guns or other weapons while the EPO is active.
  • Other possible orders: child custody, substance abuse treatment, or counseling, depending on your case.

Limits — What an EPO Doesn’t Do

  • An EPO does not dissolve a marriage or change child custody permanently by itself.
  • It does not establish legal parentage if it’s not already recognized.
  • Because it expires quickly (5–7 days), it’s not a long-term protection — you will likely need to follow up with a restraining order to maintain legal protection.

Serving the EPO

  • Once the EPO is issued, someone (not you) must serve the restrained person with a copy.
  • You can use a sheriff/marshal (usually free) or a private process server (if needed).
  • After service, the server fills out Form DV-200 (Proof of Personal Service) and returns it to the court.
  • If the restrained person avoids service, your attorney can ask the court for alternative service methods.

Legal Consequences of Violating an EPO

  • Violating an EPO is a crime under California Penal Code § 273.6.
  • If the restrained person knowingly disobeys (e.g., contacts you, enters prohibited areas), they may be arrested and prosecuted.
  • Penalties can include: Misdemeanor: up to 1 year in county jail and/or a fine of up to $1,000.
  • Felony (depending on history or severity): potentially more prison time and larger fines.
  • Defense strategies may include: Lack of knowledge of the order (procedural / notice issues)
  • Arguing that the EPO was improperly served or legally flawed.
  • Proving no intentional violation (e.g., accidental contact).
