What Is A Restraining Order?
A restraining order, also called a protective order, is a court-issued order designed to protect individuals from threats, harassment, or violence. Most protective orders are civil, but a judge can also issue a criminal restraining order. A protective order binds the person against whom it is issued—called the respondent, defendant, or restrained party—from specific actions or contact. These restrictions are meant to safeguard the person requesting the order from any harmful or threatening behavior.
A judge can issue a restraining order against a family member, household member, co-worker, friend, or anyone who poses a threat to another’s safety. Courts issue protective orders primarily to prevent stalking, violence, and abuse and are often based on the victim’s sworn testimony. For a protective order to be valid, it must be authorized by a judge and properly served on the restrained party. This means an individual cannot be found in violation of a restraining order unless they were aware that the order existed.
Some of the conditions a restraining order imposes against a defendant include the following:
- Keep a certain distance away from the victim
- Not to visit specific locations
- Have no contact with the victim for whatever reason
- Move out of the residence they share with the protected party
- Not to go anywhere near the victim's home, school, or workplace
- Surrender, sell, or store any ammunition and firearms in their possession
Failure of the defendant to obey any imposed conditions would be considered a restraining order violation, which carries criminal penalties. Violating a protective order is a misdemeanor carrying a maximum of 12 months in custody and a court fine of $1,000 for a first offense.
